At the request of the law firm RocaJunyent – Riutord Abogados<\/strong>, located in Palma de Mallorca, my expert services were requested for the analysis of digital evidence in the context of a traffic accident.<\/p>\n\n

The traffic accident was caused by a side-impact collision between a cyclist and a vehicle at a Y-junction on an interurban road. The bicycle was equipped with a GPS device that recorded the locations where the bicycle was traveling. There is no record of the vehicle involved providing any digital evidence regarding the geolocation recorded during the collision or in the moments immediately preceding it.<\/p>\n\n

The lawyer, Mr. Izquierdo, responsible for defending the cyclist’s interests, provided me with various documents, including statistical information prepared by the Traffic Department of the Civil Guard<\/strong>. A study of the GPS device installed on the bicycle on the day of the accident was also proposed.<\/p>\n\n

Following a feasibility study coordinated with the lawyer, Mr. Izquierdo and his client, a formal request was made to prepare an expert report to prove that the bicycle was traveling in its right lane at the time of impact with the vehicle involved. A study of the GPS device’s degree of accuracy was also included. The third section of the formalized expert report consisted of a study of the route history recorded in the device manufacturer’s cloud. Thanks to the client’s cooperation, the report also included photographic evidence of the bicycle’s condition after the accident, as well as a reconstruction of the positions occupied by both the cyclist and the bicycle at the junction in question after the impact.<\/p>\n\n

The submitted report was able to demonstrate the correct movement of the bicycle, a high degree of accuracy regarding the GPS locations recorded by the device, and the estimated location of the impact between the bicycle and the vehicle, showing a difference of several meters compared to the impact location recorded in the Civil Guard’s sketch<\/strong>.<\/p>\n\n

From a computer forensics perspective, it would have been interesting if the other vehicle involved in the accident had been able to provide digital evidence regarding geopositioning, trajectory, or speed. In this regard, it is only a matter of time before new vehicles incorporate monitoring systems, as the EU has already made available Commission Regulation 2025\/1707 of July 25, 2025<\/a> and Regulation (EU) 2023\/2854 of the European Parliament and of the Council of December 13, 2023<\/a>, also known as the Data Act<\/strong>. These introduce concepts that allow the information captured or recorded during the use of vehicles, both electric and internal combustion, to be brought closer to the technical-expert analysis typical of forensic computer engineering.<\/p>\n\n

Specifically, Commission Regulation 2025\/1707 of July 25, 2025, lists various algorithmic concepts for calculating ratios, data structures, and flowcharts. Proof of the computer-related nature of this regulation is based on the fact that the word “byte” is mentioned 157 times, while the word “data” is mentioned 368 times. For its part, in the Data Act (Regulation (EU) 2023\/2854 of the European Parliament and of the Council of December 13, 2023), the word “data” is mentioned 1,659 times. Therefore, the approach taken in these regulations highlights the importance of expert reports analyzing this data being carried out by duly qualified computer experts and, in the case of those autonomous communities with mandatory professional registration, also registered with their respective College of Technical Engineering in Computer Science.<\/strong><\/p>\n\n

Regarding the Data Act, the law firm Garrigues<\/strong> offers information on its website about the data subject to said Data Act.
